    There is a clear distinction between “Amazon” window shop and windowshop.com
    This must be a lawyer joke, right?

    There is no way that anyone can ‘own’ the two words window shop… how can these folks imagine Amazon infringes on something we all own – we window shop.

  2. In 2002, the U.S. Patent & Trademark Office reviewed our application and granted us a trademark on the name Window Shopping in online shopping. We had been using the name online since 1996 and in trade since 1991.

    From 2000 to 2008 our domain name was http://www.windowshoppingusa.com and in January 2008 we changed it to http://www.windowshoppinginternational.com. But this isn’t about domain names. It’s about trademark infringement.

    AmazonWindow Shop appeared in Fall 2008 – twelve years after we started using the name online and six years after we were granted the trademark on this name. Their domain name is http://www.windowshop.com but their trademark application is for AmazonWindow Shop.

    We believe their name and domain name are confusingly similar to ours. If a big company added their name in front of your trademarked business name in the same exact business category, wouldn’t you be questioning this?
